In relation to driving we can deal with the following types of cases.
- Careless Driving
- Dangerous Driving
- Death by Dangerous Driving
- Drink Driving
- Driving without Insurance
- Speeding
- Taxi Drivers
- Exceptional Hardship
- Special Reasons
In relation to driving there are generally two key avenues that are put forward which can arise. Firstly the argument of SPECIAL REASONS even where you may be pleading guilty you may ask the Court to not consider disqualification, points or a fine where there are Special Reasons as to why you took a certain course of action.
The second line of defence is EXCEPTIONAL HARDSHIP where a driver is given 12 or more points in a 3 year period the driver is subject to a minimum disqualification period of 6 months. However when it can be established that Exceptional Hardship applies namely that the driver will suffer Exceptional Hardship as a result of the disqualification, for example he may lose his job, he may lose his accommodation, the Magistrates can be asked to allow them to continue to drive and not to impose a disqualification or to shorten the period of disqualification to less then 6 months.
